1. Acceptance of terms
By accessing or using Bitxmax services, including the website at Bitxmax.com, mobile or desktop interfaces, APIs, or any related features, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our policies referenced herein.
If you do not agree with these Terms, do not access or use our services. Where permitted by law, we may require additional consent for certain features, products, or jurisdictions.
2. Eligibility
You represent and warrant that you are of legal age and have the legal capacity to enter into these Terms under the laws of your jurisdiction. You further represent that you are not a person barred from receiving services under applicable laws, including sanctions, embargoes, or export restrictions.
- Individual users: Must be the age of majority in their jurisdiction and not subject to disqualifying restrictions.
- Entity accounts: Authorized representatives must have valid authority to bind the entity to these Terms.
- Prohibited jurisdictions: We may restrict or prohibit access in certain countries, regions, or territories as required by law.
3. Account registration
To access certain features, you may need to create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
4. Compliance and AML/KYC
Bitxmax implements anti-money laundering (AML) and know your customer (KYC) procedures. We may request identity verification, source-of-funds documentation, and other information to comply with legal obligations and risk management requirements.
- Verification: We may suspend or limit services until verification is complete.
- Monitoring: Transactions may be monitored for suspicious activity, and reports may be filed with competent authorities.
- Sanctions screening: Users may be screened against sanctions lists and other watchlists as required by law.
5. Risk disclosure
Digital assets are volatile and high-risk. Prices can fluctuate significantly, and you may lose some or all of your capital. Past performance is not indicative of future results.
Market conditions, liquidity constraints, technology failures, regulatory changes, and cybersecurity events can adversely affect your access to or use of the services and the value of digital assets.
6. Trading rules
When placing orders, you agree to abide by our order types, matching engine logic, market integrity rules, and fair access policies. We may cancel, reverse, or adjust transactions in cases of market disruption or clear error.
- Order types: Market, limit, stop, and conditional orders may be supported as described in product documentation.
- Market data: Indicative data may be provided by third parties; we do not warrant completeness or accuracy.
- Halts and circuit breakers: We may suspend trading to maintain orderly markets.
7. Fees and pricing
Fees are disclosed prior to order submission and may vary by product, volume, and market conditions. Any reference pricing displayed on this page is fetched dynamically from external APIs; no static prices are used.
8. API use
Bitxmax provides APIs for price discovery, order placement, and account management subject to separate documentation and rate limits. You agree not to abuse endpoints, circumvent restrictions, or compromise service stability.
- Keys: Keep API keys secret. Rotate keys periodically and scope permissions minimally.
- Rate limits: Respect published rate limits; we may throttle or revoke access for violations.
- Attribution: When redistributing market data, comply with source attributions and licensing terms.
9. Security
We employ administrative, technical, and physical safeguards designed to protect accounts and data; however, no system is entirely secure. You bear responsibility for endpoint hygiene and secure configuration of client devices.
We may notify you about critical security updates via the email associated with your account or in-product notifications.
10. Privacy
Your data is processed in accordance with our Privacy Policy. Where applicable, you may have rights regarding access, correction, deletion, and portability subject to legal exceptions.
We may use anonymized and aggregated data for analytics, product improvement, and security monitoring purposes.
11. Limitation of liability
To the maximum extent permitted by law, Bitxmax and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
In no event will our aggregate liability exceed the amount you paid for the services in the twelve (12) months preceding the event giving rise to the claim.
12. Suspension and termination
We may suspend or terminate your access for violations of these Terms, legal obligations, risk concerns, or at your request. Upon termination, your right to use the services ceases immediately, subject to any surviving provisions.
13. Governing law and dispute resolution
These Terms are governed by applicable law as specified in your onboarding documentation or by the applicable service provider entity. Disputes may be resolved through arbitration or courts of competent jurisdiction as permitted by law.
14. Changes to these Terms
